Lawsuit Continues Against Anti-Knife NYC D.A.

The lawsuit Knife Rights filed against District Attorney Cyrus Vance and the City of New York on June 9 continues to move forward, according to the Knife Rights e-mail newsletter.

Vance ordered the raid of retail stores in Manhattan in June 2010, confiscating 1,300 “illegal knives” and ordering the “offending” stores to turn over all their “illegal” knife inventory and their profits from the past four years of selling such knives, or face prosecution (see page 26, November 2010 BLADE®). Most of the so-called illegal knives were perfectly legal box cutters and standard one-hand-opening knives, among others.

The State of New York has been dropped as a defendant in Knife Rights’ suit after it was determined that the events occurring in New York City are strictly a New York City issue rather than an issue of state law. “That is good for us,” the Knife Rights e-mail newsletter noted.

“Recently, the City filed its response to our complaint, and as expected, DA Vance filed a motion to dismiss the suit,” the newsletter stated. “We are presently working to respond to the DA’s motion.”

According to the Knife Rights newsletter, the City does not appear to dispute the lawsuit’s basic claim that NYPD officers are using New York’s “gravity knife” law to prosecute possession of common and ordinary folding knives. “As anticipated, it appears that both the City and the DA intend to argue that the ‘gravity knife’ law encompasses one-hand-opening and assisted-opening folding knives, and hence, that the law is not ‘impermissibly vague’ as we claim,” the newsletter continued. “That circular argument is no surprise; after all, that’s the root of the lawsuit and those are the issues we are prepared to go to trial on.”

The newsletter indicated a magistrate judge has been assigned and a court conference has been scheduled for early November. “We are hopeful that we will be able to begin discovery from the City and DA Vance after this conference,” the newsletter noted. “No doubt there will be potholes aplenty along this road, but that’s how it works when you go toe-to-toe with one of the most powerful cities and DAs in the country. We’re up to the fight. 

“In the meantime, never carry your knife clipped to your pocket in New York City. Even when [the knife is] covered by a jacket, simply moving the jacket aside to get to a wallet [and thus exposing the knife] has been enough to get folks arrested.

Florida Anti-Knife Bill Derailed

Florida HB 179 and companion bill SB 356, which would have made it illegal to carry a “common pocketknife” on school grounds in Florida, have been “withdrawn,” according to the Knife Rights e-mail newsletter.

“Knife Rights, along with our good friends at Florida Carry, shined a bright light on this unnecessary legislation and helped to derail it,” the Knife Rights e-mail newsletter reported.

According to the Florida Senate website (www.flsenate.gove/Session/Bill/2012/0179), the general bill, if passed, would have prohibited “possession of [a] common pocketknife, except as authorized, at [a] school-sponsored event or on [the] property of any school, school bus, or school bus stop.” Also according to the website, on Oct. 24, the bill was “withdrawn prior to introduction” in the Florida House.

Knife Show Circuit Heats Up This Weekend

Three knife events—the Kentucky Cutlery Association Show, the Boise Knife Show and the Art Knife Invitational—all will be conducted this weekend.

Collector Shares Young Sub-Chute Knife

 

 

Collector Adam Jacobs (right) had wanted a John Young (left) sub-chute knife for quite some, and his wait came to an end at the recent Plaza Cutlery Knife Show.

 

“I am an avid collector and huge BLADE® fan,” Jacobs noted. “My friend, Steven Garsson, got me into collecting knives in 2004, and since then I have been fortunate to acquire many pieces by some of the greats.  My favorite fixed blades are made by John Young, and, in 2005, I asked John to make me a custom sub-chute.  He made the knife this year and I took delivery on it at the Plaza show.

 

“It is one of only six knives total in existence with John’s rare signature logo. I humbly feel it is a pretty impressive piece and wanted to share it with you. Hiro Soga photographed the knife.

 

“John really enjoyed the challenge of this piece,” Jacobs continued. “I intentionally asked him to be creative and work outside his normal Loveless patterns and constraints.

 

“I wanted an amber-stag-handled melding of a chute blade with a sub-hilt handle, but with John’s own unique talent and vision—you don’t tell DaVinci how to paint. I think collectors and the art of knifemaking is well served when we encourage brilliant makers like John Young to do something new!”

One Man’s Tour of the Victorinox Factory

Daniel Terdiman, staff writer for CNET News, always thought it would be cool to see how Victorinox Swiss Army Knives were made. His wish came true on a recent trip to the central Swiss town of Ibach, and the Victorinox factory. 

As he notes, “There’s no doubt about it, a visit to the Victorinox factory in this small town in central Switzerland affords a guest a visual feast, and as part of Road Trip 2011, I was lucky enough to get to gorge on it.”

Dozier 9-11 Knife Raises $1,525 For Benefit Fund

The Bob Dozier 10th anniversary 9-11 knife sporting a damascus blade that includes steel from the South Tower of the World Trade Center brought $1,525 in an auction that concluded earlier this week, with proceeds going to the New York Police and Fire Widow’s and Orphans Benefit Fund.

The bid for the winning knife—the folder was featured on page 50 in the December BLADE®—was submitted by retired New York City firefighter Keith Kaiser.

Forged by Daryl Meier, the knife’s blade includes a piece of South Tower steel and 1095 carbon steel. The pre-ban ivory handle boasts scrimshaw scenes by Sandra Brady. On one side is “We Remember 9-11-2011” commemorating the 10th anniversary, and the New York city skyline, including a shadow outline of the Twin Towers in place of the missing jet in a flyby jet formation, and a soldier saluting. On the flip side is a scene of firemen fighting the fires of the Twin Towers before they fell, an American flag, and the words, “Lest We Forget 9-11-2001.”

“There will never be enough to repay our debt for what [the first responders] paid,” Dozier noted. “All proceeds from the auction of this knife will go to help the families of the firefighters and policemen who lost their lives that day.”
